1. Agreement
This website (http://nestoba.com/) and/or the Nestoba App (together, 'Nestoba Platform') is operated by Birmod Kingdom of Businesses Private Limited, a company incorporated in India. Please read these terms of use (“Terms of Use”) carefully before using the Nestoba Platform and the services offered by Birmod Kingdom of Businesses Private Limited, its affiliated companies (together, “nestoba”) or third-party operators (the “Operator”) through the Nestoba Platform (the “Services”).
Nestoba reserves the right to modify these Terms of Use at any time, in its sole discretion. It's your responsibility to regularly review these Terms. If you continue using the Nestoba Platform and Services after modifications, you'll be deemed to have accepted the updated Terms.
2. Services Offered
Nestoba, through its Platform, connects Users with properties managed, owned, or partnered with third parties ("Partners"). Nestoba offers Users stay services ("Nestoba Services") and products ("Nestoba Products"), including:
- Hotel bookings
- Accommodation services
- Other related services
Nestoba facilitates bookings and services as per agreed terms with Partners and Users.
Here's what you can expect:
- Variety of hotels to suit your needs
- Room booking voucher for confirmed bookings
- Customer support for finding suitable accommodations
- Alternate accommodation or refund if check-in is denied
Amenities like:
- AC rooms with TV
- Wi-Fi
- Clean linen
- Hygienic washrooms
- Daily housekeeping
- 24/7 front desk support
- 24/7 guest support helpline or support page for assistance
We ensure a comfortable stay experience from booking to check-out.
3. Eligibility Criteria
You must be at least 18 years old to use Nestoba. If you're under 18, you can only use Nestoba with a parent or guardian's supervision and under their registered account. We can terminate your access if we find you're under 18.
4. Account Setup and Usage
To use Nestoba Services, create an account ("Account") with your ID and password. You're responsible for keeping your Account info secure and confidential. You must:
- Notify us immediately if your Account info is compromised
- Log out after each session
- Update your account details if you change your mobile number or telecom provider
You're liable for losses due to unauthorized use of your Account. We may allow limited access to unregistered users. When registering, ensure your info is complete, accurate, and up-to-date. Don't use someone else's Account info.
5. Agreement Duration and Termination
You can cancel your Nestoba account anytime. We can also terminate your access without notice if you breach these Terms.
6. Customer-Specific Terms
If you're using Nestoba services, these terms apply:
A. Booking Services
- After sign-up one-time Adhaar Verification is mandatory for all users
- No need to submit hard copy of identity or any other details at property at the time of check in
- Be cautious when sharing personal info; don't use public computers or unsecured networks.
- Check service details and prices carefully before booking.
- You're responsible for ensuring you're eligible to book and pay for services.
- We may cancel orders if we detect suspicious activity.
- Use your own payment methods and ensure they're valid.
B. Payment
- Pay the listed usage fee via our payment methods.
- We use third-party payment providers; we're not responsible for their errors or delays.
- Payments go to the entities listed on our Payment for Services page.
C. Responsibility
- Take care of your belongings; we're not liable for losses or damages.
- We may verify your identity for security purposes, including checking third-party databases.
- Guests are responsible for their actions and compliance with these Terms.
7. Platform Usage Guidelines
Nestoba platform may contain inaccuracies or errors. We're not responsible for typographical or pricing errors and reserve the right to cancel orders with incorrect prices or descriptions.
We don't guarantee the accuracy, completeness, or reliability of our services or information. We're not liable for damages or losses due to:
- Errors or omissions
- Delays or inability to use our platform
- Non-availability during maintenance or technical issues
- Downloading material or data from our platform
You use our platform at your own risk. We may:
- Restrict access or features
- Modify or improve our platform and services
- Introduce new features or requirements
- Enable features that allow others to act on your behalf
We can't guarantee continuous availability due to internet nature or technical reasons.
8. Content Restrictions
When using Nestoba, you must not:
- Provide false, inaccurate, or misleading info
- Infringe others' rights or intellectual property
- Post defamatory, libelous, or harassing content
- Upload viruses, malware, or harmful code
- Engage in unauthorized activities, such as:
- Data scraping or harvesting
- Spamming or sending unsolicited emails
- Circumventing security features
- Impersonating others
- Selling or transferring your account
- Use Nestoba for commercial purposes without permission
- Interfere with or disrupt our platform or services
We reserve the right to block or terminate access if you violate these terms.
9. Communication Channels
When using Nestoba, you agree to communicate with us through electronic records. We may contact you via email or other modes, and you consent to receive communications from us.
We're not responsible for:
- Unauthorized access or alterations to your data
- Errors in transmission or third-party breaches
- Phishing attacks on you
You can manage cookies when accessing Nestoba; it's your responsibility to set your browser accordingly.
10. Third-Party Links
Nestoba may include links to external websites or platforms, which are not owned or controlled by us. These links are provided for your convenience, and don't imply endorsement or affiliation.
We're not responsible for:
- Content, links, or services on external sites
- Privacy practices of external sites
- Accuracy, quality, or availability of services on external sites
We don't review or verify external sites regularly and disclaim any liability for:
- Deficiencies or issues with external sites
- Content, accuracy, or services on external sites
By accessing external links, you do so at your own risk. You're responsible for decisions made based on external site content.
11. Intellectual Property Rights
Nestoba platform and content, including text, graphics, logos, audio, video, and interfaces, are protected and owned or licensed by Nestoba ("Nestoba IP"). You can't:
-Use, one time Adhaar verification integration for paperless Check in Nestoba IP
- Modify, publish, or reproduce Nestoba IP
- Sell, license, or distribute Nestoba IP
- Create derivative works from Nestoba IP
- Frame, hyperlink, or mirror Nestoba IP
When you contribute content to Nestoba, you grant us a:
- Royalty-free, perpetual, and irrevocable license
- Non-exclusive right to use, publish, and distribute your content
- Waiver of claims to the contrary
You represent and warrant that:
- You own or control the rights to your contributed content
- Your content doesn't infringe on third-party rights
12. Service Warnings and Disclaimers
Nestoba provides services "as is" without any warranties. We don't guarantee:
- Services meet your requirements or are uninterrupted
- Results are effective, accurate, or reliable
- Quality meets your expectations
- Errors will be corrected
We're not liable for interruptions or delays. Nestoba and partners are separate entities; we're the first point of contact for disputes.
13. Liability Limitations
Nestoba isn't liable for any damages, including:
- Direct, indirect, incidental, punitive, exemplary, or consequential damages
- Loss of use, data, or profits
- Intangible losses
from using our platform, services, or information, regardless of the cause.
Our total liability is limited to the price paid for the specific service or product that caused the issue.
You waive all claims related to Nestoba, its services, or these terms after 1 year from the incident.
If we're required to pay damages, we can recover the amount from fees owed to our partners.
14. Terms Updates and Changes
Nestoba can update these Terms at any time. We'll notify you of significant changes, but it's your responsibility to check for updates. Continued use of Nestoba implies acceptance of revised Terms.
15. General Terms and Conditions
A. Governing Law and Jurisdiction:
- These Terms and transactions on Nestoba are governed by Indian laws.
- Disputes are subject to jurisdiction of Nagpur Court.
B. No Waiver:
- Nestoba failure to enforce any right or term doesn't waive it.
- We can still enforce it later.
C. Severability:
- If part of these Terms is invalid, the rest remains in effect.
- Unenforceable provisions won't affect other provisions.
16. Digital Audit Policy
Nestoba conducts digital audits to ensure accuracy and compliance in bookings made through our platform, OTAs, website, and other channels.
- Audit scope: Verify booking processes and detect undisclosed occupancy or non-compliance.
- Findings visibility: Results are shared with property operators via the Nestoba app for review and rebuttal.
- Penalties: Non-compliance may incur a penalty equivalent to the average room rent per finding.
- Policy updates: Nestoba reserves the right to modify this policy; operators must comply with updated terms.
This policy is part of our agreement and extends our terms and conditions.
17. CCTV Operations and Records Access
The Operator shall ensure that CCTV cameras installed at the Property shall not be tampered with in any manner, including but not limited to, changing the angle or position of the cameras, disconnecting, covering, or switching them off. Any such act, whether intentional or unintentional, will be considered as breach of this Agreement. In the event of any unauthorized tampering or switching off of the CCTV cameras, the Operator shall be liable to pay a penalty of INR10,000 (INR Ten Thousand Only) per incident, and the same shall be adjusted from the security deposit and may also lead to immediate termination of the Agreement and the property will be blacklisted without any notice.
Operators must provide Nestoba access to property records, guest registers, CCTV footage, and financial documents upon request to monitor unauthorized access or intrusions.
18. Toilet Kit Management
- Maintain a minimum 30-day stock of toilet kits.
- Place orders via Nestoba Platform with 15 days' lead time.
- Pay for kits in advance by depositing money into the designated Nestoba account.
- Failure to maintain stock may incur a penalty.
19. Uniform Audit
- Ensure staff wear clean, presentable uniforms suggested by Nestoba during work hours.
- ₹10,000 penalty per property for non-compliance, deducted from operator payouts.
- Repeated violations (up to 3 months) may lead to property blacklisting without notice.
20. Google My Business Rating
Nestoba monitors Google ratings to ensure a positive guest experience. Operators must maintain a rating of 4.5 stars or above.
Penalty:
- Rating falls below 4.5 stars (by 0.2 star): ₹10,000 deducted from operator security deposits.
- Repeated drops (up to 3 months): ₹10,000 penalty/month; property may be blacklisted without notice after 3 months.
21. Guest Billing Compliance
Operators must:
- Provide guests with invoices at checkout via email, WhatsApp, or hard copy if needed.
Non-compliance may incur:
- ₹10,000 penalty per instance, deducted from Security Deposit.
- Repeated non-compliance may lead to property blacklisting without notice if Security Deposit isn't reinstated within 5 days.
22. Audit Access
Operators must allow Nestoba or authorized reps access to the property for audits, inspections, or reviews.
- Denial of access may incur:
- ₹10,000 penalty per instance, deducted from Security Deposit.
- Repeated denials may lead to property blacklisting without notice if Security Deposit isn't reinstated within 5 days.
23. Early Check-In
- Standard check-in time: 11:00 AM (unless specified otherwise).
- Early check-in available subject to availability; extra charges may apply.
24. Late Check-Out
- Standard check-out time: 10:00 AM (unless specified otherwise).
- Late check-out subject to availability; can't be guaranteed in advance.
25. Terms for Operators: Customer Record Keeping
Maintain records of customers as:
- Masked Aadhaar number
- Gender
- Age
- Contact number
Don't access or store other sensitive info; doing so breaches the agreement and may lead to immediate property blacklisting.
For police verification, operators can request temporary access to customer details.
